LIMITED WARRANTY
KINDER SCIENTIFIC warrants to the original purchaser of each KINDER SCIENTIFIC system (“Equipment”) that it is free of defects in material and workmanship for a period of three years from the date of purchase from KINDER SCIENTIFIC. This warranty is non-transferable.
A. KINDER SCIENTIFIC will, at its option:
(a) repair or replace any part or parts of the Equipment;
(b) issue a credit to the purchaser equal to the original Purchase Price against the purchase of the replacement Equipment; or
(c) provide a functionally comparable replacement Equipment at no charge.

C. This Limited Warranty does not apply to any KINDER SCIENTIFIC Equipment or part that has been:
(a) Damaged by accident, abuse, misuse, or tampering;
(b) Modified without written permission of KINDER SCIENTIFIC;
(c) Used contrary to the instructions and warnings specified in the KINDER SCIENTIFIC instruction manual for the respective Equipment;
(d) Serviced or repaired by anyone other than KINDER SCIENTIFIC or its agents unless approved in advance; or
(e) Damaged by the use of accessories or in conjunction with devices other than genuine KINDER SCIENTIFIC Equipment, accessories, systems, components or devices.
D. THIS WARRANTY DOES NOT INCLUDE ANY IMPLIED WARRANTIES OR ANY WARRANTY OF ANY TYPE INCLUDING WITHOUT LIMITATION MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE EXPRESSLY CONTAINED HEREIN. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF OTHER WARRANTIES, WHETHER WRITTEN, ORAL OR IMPLIED.
E. EXCEPT AS EXPRESSLY PROVIDED BY THIS LIMITED WARRANTY, KINDER SCIENTIFIC IS NOT RESPONSIBLE FOR ANY DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES BASED ON ANY DEFECT, FAILURE OR MALFUNCTION OF THE EQUIPMENT, WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT OR OTHERWISE.
F. THIS LIMITED WARRANTY IS MADE ONLY TO THE PURCHASER OF THE EQUIPMENT. AS TO ALL OTHERS, KINDER SCIENTIFIC MAKES NO WARRANTY, EXPRESS OR IMPLIED. NO EXPRESS OR IMPLIED WARRANTY TO YOU SHALL EXTEND BEYOND THE PERIOD SPECIFIED ABOVE. THIS LIMITED WARRANTY SHALL BE THE EXCLUSIVE REMEDY AVAILABLE TO ANY PERSON.
G. The exclusions and limitations set out above are not intended to, and should not be construed so as to contravene mandatory provisions of applicable law. If any part or term of this Limited Warranty is held to be illegal, unenforceable or in conflict with applicable law by a court of competent jurisdiction, the validity of the remaining portions of the Limited Warranty shall not be affected, and all rights and obligations shall be construed and enforced as if this Limited Warranty did not contain the particular part or term held to be invalid. This Limited Warranty gives you specific legal rights. You may also have other rights that vary from state to state or country to country.
H. No person has any authority to bind KINDER SCIENTIFIC to any representation, condition or warranty except this Limited Warranty.
I. MANUFACTURER’S RECOMMENDATION. It is strongly recommended that users of KINDER SCIENTIFIC Equipment become thoroughly familiar with the device prior to use. To assist in this effort, KINDER SCIENTIFIC offers several options. Contact KINDER SCIENTIFIC at Kinder Scientific.com/support for options.
J. How Does State Law Apply? The laws of the State of California, USA, govern this Limited Warranty. It gives you specific legal rights, and you may also have other rights that vary from state to state or country to country. This Limited Warranty does not affect any additional rights you have under laws in your jurisdiction governing the sale of goods. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the limitations or exclusions in this Limited Warranty may not apply to you.
